Es una discusión sobre derechos, historia, poder y pertenencia. Cuando miles de personas repiten “las playas son del pueblo”, no están usando una frase vacía ni un eslogan improvisado: están defendiendo un principio jurídico, cultural y humano profundamente ligado a la idea de los derechos inalienables.\u003cbr\u003e\u003cspan\u003e\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003eLos derechos inalienables son aquellos que no pueden ser vendidos, transferidos ni eliminados porque pertenecen inherentemente a las personas. Surgen de la idea de que existen ciertos bienes y libertades esenciales para la dignidad humana y la vida en comunidad. En Puerto Rico, el acceso al litoral conecta directamente con ese principio porque las costas forman parte del patrimonio común del país.\u003cbr\u003e\u003cspan\u003e\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eLa base legal no es nueva ni ambigua. Proviene del derecho romano y de la tradición jurídica española, particularmente reflejada en la Ley de Aguas y la Ley de Puertos del siglo XIX, donde ya se establecía que la zona marítimo-terrestre pertenece al dominio público. Ese concepto sobrevivió cambios de soberanía y continúa reconocido bajo el ordenamiento jurídico puertorriqueño moderno.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eLa zona marítimo-terrestre comprende el espacio que alcanza el mar durante las mareas más altas y el área impactada por el oleaje. Esa franja no puede ser apropiada privadamente porque su naturaleza es colectiva. Jurídicamente, pertenece al pueblo. La Constitución de Puerto Rico también sostiene la protección de los bienes de uso común y el deber del Estado de conservar los recursos naturales para beneficio general.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003ePor eso, aunque una persona o corporación pueda poseer terrenos frente al mar, no puede adueñarse legalmente de la playa ni impedir el acceso razonable del público. Ese detalle es crucial. En muchos conflictos costeros, el problema no es solamente la titularidad del terreno, sino el bloqueo físico y psicológico del acceso: portones, guardias privados, rótulos intimidantes o diseños urbanos pensados para excluir.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eY ahí es donde el tema deja de ser únicamente legal y se vuelve social.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003ePorque en Puerto Rico la playa no es un lujo. Es parte de la identidad cultural. Históricamente, las costas han sido espacios de pesca, encuentro comunitario, recreación, deporte, espiritualidad y subsistencia. Para muchas comunidades costeras, el mar representa memoria familiar y continuidad generacional. Restringir el acceso no afecta solamente el turismo o el entretenimiento; altera una relación histórica entre el pueblo y su territorio.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003eLos datos ambientales también respaldan esta realidad. Puerto Rico enfrenta erosión costera acelerada, aumento en el nivel del mar y pérdida de playas debido al cambio climático y a desarrollos mal planificados. Según investigaciones del Programa Sea Grant de la Universidad de Puerto Rico y estudios del Servicio Geológico de Estados Unidos (USGS), múltiples zonas costeras del archipiélago han perdido metros significativos de playa durante las últimas décadas. Construir demasiado cerca de la costa interrumpe el movimiento natural de arena, debilita dunas y agrava inundaciones.\u003cbr\u003e\u003cspan\u003e\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eLa naturaleza misma demuestra que las playas son espacios dinámicos, no propiedades estáticas. El mar cambia constantemente los límites de la costa. Intentar privatizarla permanentemente contradice incluso la ciencia costera básica.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003ePor eso el movimiento de defensa de playas públicas ha ganado tanta fuerza en Puerto Rico en años recientes. Casos en lugares como Rincón, Sol y Playa, Ocean Park, Isla Verde y otras zonas han provocado movilizaciones ciudadanas masivas. Personas de distintas ideologías políticas y clases sociales han coincidido en algo esencial: defender las playas es defender acceso, ambiente y derechos colectivos.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eY en el fondo, ese es el núcleo de todo esto.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003ePorque un derecho que no puede ejercerse deja de existir en la práctica. Una playa “pública” sin entrada pública se convierte en exclusión disfrazada de legalidad. Por eso el acceso importa tanto como la titularidad.\u003c\/span\u003e\u003c\/p\u003e\n\u003cp\u003e\u003cspan\u003eCuando se dice “las playas son del pueblo”, se está afirmando que existen espacios que no deben responder únicamente al dinero, al privilegio o al poder privado.
